Judge tells Eli Lilly and Co. to be ready for Zyprexa trial within a year

A federal judge has told Eli Lilly and Co., the maker of Zyprexa, to be ready for trial within a year. Charges against Lilly allege Zyprexa causes diabetes and other related problems.
The federal judge's decision is the first set deadline in the 72 federal Zyprexa lawsuits consolidated in his New York court that has been made. The majority of Zyprexa lawsuits were filed after the FDA required Lilly and other schizophrenia drug makers in 2003 to warn doctors and patients of the drugs' link to obesity and high blood pressure. Doctors were advised to monitor Zyprexa patients for the conditions.
A month ago, plaintiffs' attorneys complained to the judge in a court filing about Lilly's overly slow production of documents. The judge's decision would require Lilly and plaintiff's attorneys to speed up the discovery process by reviewing millions of pages of Lilly documents that could be included in the upcoming trial.
In addition to the consolidated federal Zyprexa lawsuits, there are about 50 more Zyprexa lawsuits filed against Lilly in state courts. The first Zyprexa lawsuit that goes to trial has the ability to shape the direction the remaining cases will go, so spectators on both sides of the suits anxiously await a case going to trial and seeing the outcome.
