More than 8,000 Zyprexa Users Await Payment

Eli Lilly, the maker of Zyprexa, is expected to mail out notices this week, informing more than 8,000 of those injured by the drug how much their suffering is worth.
The settlement marks Lilly’s largest ever and will be paid out of a $700 million dollar fund the company set up to resolve 8,362 claims. The payouts will vary according to extent of injury, but will range from a minimum of $5,000 to over $100,000 per victim.
“The awards are significant,” said New York attorney Chris Seeger, who added that more victims will receive higher payouts than those receiving the base amount. Less than 1,000 people will be paid the $5,000 minimum, Seeger said.
Approximately 75 percent of known Zyprexa claims are being covered by the settlement. Hundreds more Zyprexa lawsuits have been filed, for which Lilly has set aside another $300 million.
Checks to victims are expected to follow the notices within weeks. However, some of those payments may be delayed by state governments that want a share of the money for Medicaid payments made to injured patients.
