Mississippi Files Zyprexa Lawsuit

Mississippi Attorney General Jim Hood filed a lawsuit against the manufacture of Zyprexa, an antipsychotic prescription medication, accusing the company of deceptive marketing practices.
According to the lawsuit, Eli Lilly continued to market and sell Zyprexa for several years without warning patients that the drug increases the risk of developing diabetes.
In April 2002, almost a year and a half before consumers in the U.S. were warned of the diabetes risk, Lilly changed the drug label in the United Kingdom and Japan to reflect the potential dangers.
The lawsuit claims that the state of Mississippi has spent millions of dollars on Zyprexa for patients who should not have been prescribed the drug and who are being harmed by it.
“Our investigation presently indicates that about 10 percent of those patients who have been prescribed Zyprexa have subsequently developed insulin-dependant diabetes. Some of these patients are children, and Zyprexa has never been approved for, nor found to be effective, in the treatment of children,” said Special Assistant Attorney General Tim Balducci.
Furthermore, the lawsuit alleges that the rapid growth in Zyprexa prescriptions for non-approved uses was a direct response to Lilly’s deceptive marketing of the drug.
The state seeks to recover damages for Medicaid patients who have suffered serious harm from Zyprexa as well as punitive damages and litigation fees. The lawsuit also seeks to recover funds expended to buy Zyprexa for “non-medically approved indications.”
Balducci estimates the damages could amount to well over $30 million.
