Zyprexa Settlement Challenged

A New Orleans legal firm is challenging the legality of a proposed settlement designed to compensate 8,000 claimants who have developed diabetes as a result of Zyprexa side effects. Zyprexa-- a top selling anti-psychotic drug which accounts for one-third of Eli Lily's revenue-- has been linked to diabetes, cardiovascular emergencies, and even death. According to a Louisiana law firm, the privately negotiated settlement proposal "flies in the face" of the laws governing multi-district federal litigation.
When a large number of lawsuits filed involving a particular legal dispute, these cases are often consolidated in the courts. The federal courts have consolidated a group of Zyprexa lawsuits filed by thousands of Zyprexa injury victims. The judge overseeing the Zyprexa settlement proposed a "stay" on evidence gathering, thus preventing the attorneys from subpoenaing Eli Lilly documents, employees, and others. In addition to hindering the discovery process, the proposed settlement arguably prevents some claimants from sharing in the $700 million award. The New Orleans law firm questioning the legality of the proposed Zyprexa settlement argues their client's cases were denied eligibility in the Zyprexa settlement without valid legal grounds.
The Zyprexa settlement, if allowed to proceed, will only be approved if ninety percent of the 8,000 claimants accept the payment they are offered. The judge overseeing these federal Zyprexa cases has warned the plaintiffs' attorneys not to pressure their clients to accept a settlement payment.
According to Eli Lilly, the settlement does NOT mean the company accepts fault for any damages allegedly caused by Zyprexa. They maintain Zyprexa was appropriately marketed and is reasonably safe for consumer use. Zyprexa already carries a "black box" warning informing consumers about the serious and fatal risks associated with this antipsychotic medication.
