Zyprexa Lawsuit Filed in West Virginia
- July 11, 2006
A woman in West Virginia has filed a lawsuit against Eli Lilly, the makers of Zyprexa, alleging that the drug caused her to develop diabetes.
The plaintiff, Penelope Rogers, claims that taking the atypical antipsychotic Zyprexa caused her to "suffer injuries and damages including, but not limited to, the onset of diabetes mellitus, physical pain and suffering, mental and emotion anguish and distress, and economic loss."
In addition to Eli Lilly, ten other undisclosed defendants, including individual sales representatives and managers for the company, are named in the Zyprexa lawsuit.
"Beginning in 1996, defendants aggressively marketed and sold Zyprexa by misleading potential users about the safety of the product by failing to warn users of serious dangers which the defendants know or should have known could result from Zyprexa use," the claim states.
The Zyprexa lawsuit also alleged that Eli Lilly knew of the risks this medication posed as early as 1998, at which time clinical studies indicated a link between Zyprexa and diabetes.
Ms. Rogers is seeking compensation, punitive damages, injunctive relief, court costs, attorney fees, post-judgment interest, and more.
