Judge denies motion to delay Zyprexa payments

U.S. District Court Judge Jack B. Weinstein turned down a motion set forth by a New Orleans attorney to delay payment to 8,100 Zyprexa patients who have claimed abnormal weight gain and possible diabetes due to the drug. Pharmaceutical company Eli Lilly settled the suit at $700 million, estimated to average $5000 per claim and possibly more. These patients, who used Zyprexa to treat schizophrenia and other psychological disorders, can now expect to be paid as early as this spring.
John D. Sileo requested the delay in payment to thousands awaiting compensation claiming that he represented 12 Zyprexa users who were not included in the settlement. He argued that because of the secretive negotiations between Lilly and the attorneys, his clients were unfairly excluded from the settlement. The judge however, refuted the allegations and the payment of the Zyprexa settlement is expected to occur within the coming year.
A Lilly attorney argued in the case that a confidential settlement does not wrongfully exclude anyone and suggested that Sileo should have involved himself more aggressively in the litigation process. Head of the plaintiffs' committee, Melvyn Weiss stated in a filing that Sileo and anyone else is free to file additional cases against Lilly, independent of the initial settlement and will be free to use the plentitude of documents that were made available to the lawyers of the original settlement by Eli Lilly.
