Consumers File Lawsuit against Eli Lilly over Zyprexa
- January 10, 2006
Seven injured consumers in the Midwest have initiated another Zyprexa lawsuit, claiming Zyprexa has caused them diabetes and pancreatitis. Zyprexa was released on the market by pharmaceutical kingpin Eli Lilly in 2001 for the treatment of acute manic episodes. The drug has commonly been prescribed to patients suffering from bipolar disorder and schizophrenia.
The St. Louis firm representing the plaintiffs allege that Eli Lilly and Company were aware of the serious risks associated Zyprexa almost immediately after the drug's release. Reports of diabetes and other adverse side effects were fielded by the Food and Drug Administration's medical watch and were known by the pharmaceutical company well before they took precautionary measures to notify health professionals and the public.
In addition to claiming knowledge of serious side effects of the drug, the lawsuit alleges that Eli Lilly failed to comply with federal orders from the FDA to update the labeling of Zyprexa. Due to mounting concerns regarding the association between atypical antipsychotic drugs and the onset of diabetes, the FDA notified drug manufacturers that they must include a warning regarding these risks in the prescription labeling.
Despite the mandate which was issued on September 11 of 2003, Eli Lilly failed to notify doctors of the harmful side effects until the following March when a letter was sent regarding the health risks. The changes were not initiated in the Physician's Desk Reference until 2005.
Angered consumers who have been adversely affected by Zyprexa are claiming had they known the deadly side effects of the drug initially, they would have made an informed decision to not take Zyprexa. For many, when the physicians finally received information regarding the detrimental side effects of the drug, irreparable harm had already occurred.
